"DICK JOHNSON TIPS AND TRICKS" PROMOTION

HOW TO ENTER

To enter, entrants must visit www.tipsandtricks.com.au; follow the prompts to the competition entry page and including their best tip and trick on how to maintain/fix an automotive vehicle and why they should be a member of the Dick Johnson Racing (DJR) team for the V8 Supercars Grand Final at Oran Park and submit the fully completed entry form during the promotional period.

TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over.
  3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  5. Incomplete, indecipherable, or illegible entries will be deemed invalid.
  6. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
  7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  8. Promotion commences on 05/10/08. Entries close at 11:59 pm AEDST on 09/11/08.
  9. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
  10. Winners will be notified by telephone and mail.
  11. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the creativity, merit and practicality of the answer provided to the promotional question.
  12. The Promoter's decision is final and no correspondence will be entered into.
  13. The Promoter will select the best three (3) valid entries from all entries received each week of the promotional period. The best three (3) valid entries received each week, as determined by the judges, will win a Shell Helix and DJR gift pack valued at $500. The gift pack includes a Shell Helix sipper bottle, a Shell Helix sun shade, a Shell Helix car seat cover, a DJR back pack, DJR team shirt, a DJR team cap signed by one of the members of the DJR team, DJR team jacket, DJR logo cooler and a DJR team poster.

  14. All weekly prize winners will be pooled together and the Promoter will select the best entry received for the duration of the promotional period. The best valid entry, as determined by the judges, will win return economy airfares for two (2) adults to Sydney valued at up to $10,000 depending on point of departure and two (2) passes to the V8 Supercars Grand Final. The prize also includes five (5) nights twin share accommodation with breakfast at the Sunnybrook Hotel and Convention Centre and return airport transfers to and from the hotel. Cab fares will be included for the winner and their companion, to travel between their hotel and the Oran Park raceway. The winner will be given a video camera (which they can keep) to film the action and their experience. Footage of the experience will then be edited by the Promoter and placed on the Promoter's website. If the winner is not from Sydney, the prize includes return economy airfares from the winner's nearest capital city. If the winner is from Sydney then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Spending money, meals, insurance, items of a personal nature, in-room charges and all other ancillary costs are not included.

    The winner's companion will also receive a Shell Helix and DJR gift pack valued at $500. The gift pack includes a Shell Helix sipper bottle, a Shell Helix sun shade, a Shell Helix car seat cover, a DJR back pack, DJR team shirt, a DJR team cap signed by one of the members of the DJR team, DJR team jacket, DJR logo cooler and a DJR team poster.

  15. Prize must be taken to coincide with the V8 Supercars Grand Final at Oran Park with flights departing on 03/12/08 and is subject to booking and flight availability.
  16. Frequent flyer points will not form part of the prize.
  17. Prize is subject to the standard terms and conditions of individual prize and service providers.
  18. Winner may be required to present credit card at time of accommodation check in.
  19. As a condition of accepting the prize, the winner accepts and agrees to film their experience with the video camera provided. The winner can keep their original video recording (unedited) for private viewing but may not use this video recording for commercial purposes nor infringe broadcasting rights of a third party. If they do, Shell will not be responsible for their actions. As a condition of accepting the prize, the winner and their companion licence the Promoter to use their recording in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes without any further remuneration. The winner warrants to the Promoter that: (a) the recording submitted is an original work of the winner or, where the recording (or part of the recording) is the work of their companion, that he/she has obtained all necessary permissions from that travelling companion to give effect to this clause; and (b) the work does not infringe the rights of any third party (other than the winner's companion).
  20. If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
  21. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
  22. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
  23. If for any reason a winner does not take the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
  24. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  25. Total prize pool value is up to $18,000
  26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  27. Entrants consent (in the event that they are a winner) and the winner's companion consents (as a condition of participating in the prize) to the Promoter using his/her name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  28. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  29. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  30. The Website's database clock will be the official timekeeper of the Promotion. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the participant. Promoter cannot be held liable for any entries lost, intercepted or not received by the Promoter for any reason. Further, the Promoter cannot be held liable for system failures on the Website, telephone lines or delivery channels or for in access or unavailability of the internet or the Website or the SMS service or any combination thereof.
  31. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  32. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the appearance of any or all of the competitors at the V8 Supercars Grand Final event is cancelled or the V8 Supercars Grand Final is cancelled for any reason beyond the reasonable control of the Promoter; or (f) use of a prize. Where the law implies warranties which cannot be excluded, the Promoter's liability for breach of those warranties is limited to re-supplying the prize (or paying for the costs thereof), where this is permitted by law.
  33. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Subject to this paragraph, all personal information collected from entrants will be handled in accordance with the Shell Privacy Policy which can be accessed by visiting www.shell.com.au.
